California Democrat – lets give 1 million illegal immigrants amnesty

Perhaps I’m missing something here but hasn’t the main argument of this administration about the various immigration laws passed by states been that immigration is the solely the job of the Federal Government?

Isn’t it true that they’ve challenged various state level immigration laws on those very grounds?

So what gives with this:

Nearly 1 million undocumented immigrants could live and work openly in California with little or no fear of deportation under an initiative unveiled Friday by a state legislator and others. Assemblyman Felipe Fuentes, a Democrat, is helping spearhead the measure, called the California Opportunity and Prosperity Act.

The proposal was filed Friday with the state Attorney General’s Office, marking a first step toward a drive to collect the 504,760 voter signatures needed to qualify for the ballot. Fuentes called the measure a "moderate, common-sense approach" necessitated by the federal government’s inability to pass comprehensive immigration reform.

"I hope this shows Washington, D.C., that if they fail to act, California will take the lead on this critical issue," Fuentes said in a written statement.

They will? 

I’m sure Eric Holder’s DoJ will be asking, fairly quickly, by what right California assumes the right to do such a thing.  You know, in other states, they were at least trying to enforce existing federal law when they were challenged.  Here’s a guy trying to circumvent it.  I would assume that would give the chief law enforcement officer, who has been so quick to jump on those states trying to enforce existing federal laws, to be on this guy like white on rice.

Regardless whether Californians would support such a measure, implementation would depend upon the federal government agreeing not to prosecute participants.

Well, lets see … didn’t California legalize medical marijuana and didn’t the feds say it didn’t matter because it was against federal law to engage in such activity?  And didn’t they continue to prosecute marijuana cases and raid supposed “legal” providers?

So what about circumventing federal law in this case?

Mr. Holder?

Oh, and of course, nothing could go wrong with this could it?  A “million” illegals get amnesty.  California becomes a magnet for illegals.  Pay taxes?  Why? They’re illegal and there’s no penalty for that.  Why fess up and pay taxes?  California has already said it’s not going to deport them.  That doesn’t mean they’re then going to pay taxes for heaven sake.

Another brilliant idea brought to you by a  … Democrat.

    1. states have no power to “deport” to begin with
    2. how the hell could Mr. Fuentes stop the Federal LEOs?
    3. I would bet $$$$ that Holder would NOT sue
    4. why would SUCCESSFUL illegals underground, come above ground to pay taxes?
    5. how could a state law denote a status that directly conflicts with…and is taken as the province of…Federal power?

  • Probably political grandstanding. The Democrats with the help of many Republicans have sold the false smear that being anti-illegal alien is being anti-Hispanic.

    • @jpm100 The truth is that many long-time illegals have kids who are legal, due to being born here. So, even if you deport the parents, they could simply go to the US embassy and apply for a green card based on family re-unification and get one.

      I think a good plan would find a way to allow those people to get their green cards. They aren’t going back to Mexico and their kids are citizens anyways.

      This would help relieve the perception on the Hispanic side that people are just “anti=Mexican”. And of course some people are just that. Some small percent of anti-illegal immigration people are racist. Sucks for the rest of us.

      • @jpm100 For example, my wife was in ESL class and one of her classmates was an illegal woman, who’s husband was a citizen, and who’s kids were all born in the USA. She’s just being lazy about getting the paperwork done (its a pain, and she may be uncertain about succeeding.) What’s the point in deporting her? Oh, for rule of law purposes she should be deported, but in a manner where she goes to Mexico for a week and gets her papers and comes back.

      • @Harun @jpm100 I believe you are completely wrong. You cannot apply for any legal status under current law if you are here illegally (except…MAYBE…asylum).

      • @Harun so lets entrench the anchor baby path to citizenship.

        I would grudgingly agree to that form of amnesty only if it came with a revision to the constution going forward disallowed citizenship for future children of illegal immigrants.

        For children of one legal resident non-citizen and one illegal resident, I would give a conditional residency with a normal waiting period for citizenship. The condition would be that the legal resident must have a significant level of legal custody of the child during that time.

        And both citizens and non-citizen legal residents would require a condition of passing a check in the case of an attempt to defraud the relationship.

  • So if CA declares amnesty for these illegals, and they migrate out to other states….what does that mean? Do other states have to recognize that?

    WTF??

    CA is screwed and this isn’t going to help…….but then again, this is really all about how they’re going to vote to show gratitude.

    • On the other hand…..if CAs amnesty acts as flypaper and attracts all the illegals there from other states….maybe it’s not that bad. Let CA be overwhelmed.
