The rational basis test isn’t quite so widely used, but the underlying concept that a government with direct democratic accountability can do what it wants within a certain construct isn’t quite so shocking, is it? That a law simply have a rational relation to a legitimate governmental objective isn’t a problem for me. Determining what is a legitimate governmental objective is far more troublesome.
