This isn’t Bush Derangement Syndrome...It’s Complete Insanity

Well, we've all known—since 2000, really—that a lot of people don't like George W. Bush. And we've all known that a lot of people on the Left fundamentally doubt the president's competence and legitimacy.

But this goes far beyond that. This is a seriously written bit of complete insanity. And worse.

It's from Martin Lewis at the Huffington Post, whoever he is. In this post, he writes an open letter to General peter Pace, the CJCS, urging him to—get ready for it—"relieve the president of command".
Though you are Chairman of the Joint Chiefs of Staff and the President's principal military advisor - President Bush has shown his disdain for your honesty and wisdom. Though you are a decorated Vietnam war hero - who has served his nation honorably for four decades - the President is dispensing with your services. You have one month left in your position before you are tossed out by the President.

President Bush is going to ignore your advice. Just as he has ignored the advice of other Generals who have had the courage to respectfully point out how terribly wrong he is in respect of the Iraq War and the safety of the US military he is sworn to protect. Highly-decorated colleagues of yours such as General Anthony Zinni (Commander in Chief of U.S. Central Command), General Eric Shinseki (Chief of Staff of the U.S. Army) and General John Abizaid (Commander of the U.S. Central Command).

General Pace - you have the power to fulfill your responsibility to protect the troops under your command. Indeed you have an obligation to do so.

You can relieve the President of his command.1

Not of his Presidency. But of his military role as Commander-In-Chief.
Lewis then goes on to expound the most outrageously stupid legal theory, based on the Uniform Code of Military Justice, that would authorize such a move.

It's difficult to know where to begin to even address this kind of neutron star density of stupidity.

First, the president is not subject to the authority of the UCMJ, since the president is an elected civilian official, not a military member in any sense. Indeed, the Constitution prohibits any military member from holding any other Federal office or position of trust. Only uniformed military members are subject to the UCMJ, so none of its articles apply to any civilian, including the president. As such an court-martial convened to try the president would be invalid and unconstitutional on its face.

Second, the president, while a civilian, is the commander in chief of the armed forces. Indeed, the only reason the president is the commander in chief is because he is a civilian, in order to subordinate the military to civilian authority. Any attempt by General Pace to relieve the president as commander in chief is, no matter what the circumstances, an act of mutiny for which the general, not the president would face a court-martial.

Third, there is no possible way to relieve a president as commander in chief, while simultaneously retaining him as president. The powers of commander in chief reside inherently in the office. Any removal of the commander in chief's powers by the military, would in fact, make the CJCS the de facto dictator of the republic, in the ancient Roman sense of the word. This is a blatant violation of the constitution as well.

Fourth, the Constitution already provides for the relief of the president, through the mechanism of impeachment. It is the one and only authorized process for removing a president from office. Congress is the responsible authority for impeachment, and can impeach a president for quite literally any reason they desire.

It is difficult to imagine a course of action that would be more damaging to American constitutionalism than a military coup. And make no mistake, that is exactly what it would be.

Not only am I amazed that that anyone would seriously call for such an act, and be so flagrantly ignorant as to regard it as a good idea, I am amazed that some appear to agree, such as commenter "Sam Thornton":
The extra-Constitutional powers granted to President Bush by Congress since 9/11, coupled with the even more sweeping powers the President has granted to himself through Executive Order, have effectively made the President an absolute dictator who operates without reference to either the Federal courts or the Congress.

At present we are one Presidential signature away from becoming a formal dictatorship. Through Executive Order, the President has only to declare a "national emergency" on any pretext and he instantly takes formal control of not only the Federal courts and Congress's legislative authority, but control over all state and local authorities and — believe it or not — even over all businesses in the private sector.

I fully understand that most people will read the above with disbelief. I would encourage those who wish to explore this further to examine the texts of President Bush's Executive Orders available at http://www.whitehouse.gov in which these new powers are spelled out.

The critical question is whether or not the President will exercise these powers before the end of his term of office. On the theory that he wouldn't have gone to the trouble of claiming these powers without an intent to use them, I believe he will exercise them and that there will be no elections held in November 2008.
And don't forget the fluoridation of water, Sam, which will sap and corrupt our precious bodily fluids.

These people are total loons.

When such ignorance of history,the UCMJ, the Constitution all come together, you get stuff like this. Woolgathering at its worst.

This clown is grasping at the straw of one Pace comment that seems to agree with his view of the world, and on this straw is ready to have Pace create a constitutional crisis by "relieving" the President as CIC.

Were this kind of thing permissible under our system, Harry Truman would have been in real trouble when he fired MacArthur, a five star general. Presumably, under the clown’s theory, Mac Arthur could have fired Truman as CIC for having the bad judgment to fire Mac Arthur.

Of course, such actions are only available when a President is of the Republican persuasion.

I recommend perusing the comments at HuffPo he doesn’t have that many fans of his "plan" there. Sure there are a lot, mayhap even a majority, who like it, but there is some very good commentary pointing out that what he proposes is just illegal, unconstitutional and unworkable

This is why Bush has been such a disaster, responsible members of the military are seriously considering this. If he follows through with his plans to expand the war to Iran, it will come to this. The military has been broken by this "administration." They have to deal with reality, they don’t buy in to your theory that you can create your own reality. There are not enough troops to continue this Iraq escalation. Let alone another chickenhawk-planned disastrous escalation to Iran. And that’s what you cowardly bastards have in mind.

Seriously, the Left of today reminds me, sadly, of the Right of the 1920’s and 1930’s, more particularly the French Right. The French Right saw it’s greatest threat from the “Red” Arrondissements such as St. Denis, on the Seine, rather than across the Rhine. In fact, the French Right preferred to take its cues from across the Rhine, to fight its enemies across the Seine.

And I see the Left doing the same thing here, today. The enemy is the Republican in the White House, not the enemy overseas. So they pretty much will do about anything, think anything to defeat the REAL enemy. I pray that they never have the great awakening that their French counter-parts had in the era 1940-43. It might be enjoyable to watch the train wreck, IF IWEREN’T a FELLOW CITIZEN, of America, too. I do hope that sometime a new generation of Progressives will emerge to shuffle this generation of Progressives off to a well-deserved retirement, akin to WFB’s move to displace the Birchers from the “legitimate” Conservative Movement. (A man can hope.)

The real enemy keeps changing with you guys. This isn’t just a debating society, real people are dying. People that I know (knew.) They are dead. Dead. The sissies that sent them to die keep changing the arguments, moving the goalposts. Yes, we know that is the chance we take when we enlist. But the civilians who send people like us to die had better have better reasons than never having to lose a god-damned debate.

Pace, Murtha, Warner et al are not speaking off the top of their heads. They are plugged in to the military, they know what they’re talking about. Bushism will create a constitutional crisis if it continues. The Military will say "No More." Not for you fairies.

Yeah thanks Nimrod...Funny all my friends, IN THE MILITARY, seem to be on board with the war.

And you know what THAT’S IRRELEVANT TOO. Because you, or I or they think isn’t important...George W Bush is POTUS, elected twice, makes him CinC of the US Armed Forces. In about 17 months he won’t be, until then they and you just have to keep on keeping on.

I spent from 1992-2000 being governed by a man I despised! I lived thru it you will too. Oh and about non-veterans commanding, how about that Loser Lincoln or that Fairy Roosevelt, Franklin of course, they oversaw wars that killed HUNDREDS OF THOUSANDS that involved blunders that killed tens of thousands, and neither of them ever served a day of active duty….

And the US military is broken? Really, you mean the deployment of less than 10% of the US Armed Services in one theatre have rendered them unfit to perform operations elsewhere? Who knew good thing we never devoted 30-40% of our combat power to one theatre ever, OH WAIT….

Murtha, he’s plugged in...into what the DC money machine? Or have you forgotten the Haditha Marines and his claims about them? Or his claim that we need to redeploy to Okinawa?

Pace, Pace has his opinion, it’s a valid one, but there is another side to it. Current deployments may affect the overall readiness of the US military, it’s true. A defeat in Iraq will affect overall military readiness, too, you might remember the US military from 1974 until well into the 1980’s. Defeat has a price, too. So, we’re just going to have to tough this one out, I’d rather have a worn but vicotious military, than one that comes home defeated, a la the one from Vietnam.

Well, nimbus, if you really believe that, then rather than advocating a military coup, you should be writing your congressman and urgin that the president be impeached. that is, after all, the legal, and constitutional mechanism set up to remove a president from office.

If you, or your marine vet brother, or your navy vet brother are advocating the course of action you describe, then you are indeed moonbats, and traitors to the oath you took to support and defend the constitution of the united states from all enemies, foreign and domestic.

Nimrod:Supporting the troops does not mean celebrating deserters, seditionists, or traitors. You are the second, avocationg becoming the third.

The moment you advocate a millitary coup and dictatorship (and there is no way you can twist your argument around that fact) you become a domestic enemy. I took an oath to defend the constitution against you. This defense is currently in writing, as the attack you are making to the Constitution is in writing. Oh I get it, Pace arrests CHENEY, too...so that gets us Pelosi as CinC, I guess, and everyone knows about HER service, right? Because that’s critical to you right, that you served...

And along the way since Bush is under military arrest, but retains his political civilian powers I guess he can pardon himself and Cheney, too.

Or do you really mean he’s in the brig and so Pelosi gets to run the country. But what if Pelosi does something you and your family don’t like? Arrest her too? Or what if Pace likes being CinC and doesn’t want to retire? Can he just go on being CinC? You like Hugo Chavez too don’t you?

I get it, all those references to "homo’s" and "Nancy boys" and your love of Fascist dictatorships...it all fits together, you just were born decades too late. If ONLY you’d been in Munchen in the 1930’s you and Ernst Roehm cold have plotted the Fascist takeover, wearing your leather liederhosen and sharing a bath together! And please, I beg you, NO Ballet but most especially no OPERA reviews....uggggh! Tried to watch an opera about Odysseus, "I thought great, he’ll kill all the suitors, that should be interesting." I watched it for 30 minutes, two dudes catwauling in Eye-talian, and the plot moved about 4 minutes, I gave up...I could see it would be HOURS of Eye-talian caterwauling before we ever got inside his old palace and dealt with the suitors. I think the movie ruined it for me...just like Moby Dick, tried reading it after seeing Gregory Peck as Ahab, kept finding myself muttering, "Enough already, let’s get to the White Whale, and the ’beckoning already."

The Origins of the American Military Coup of 2012

The letter that follows takes us on a darkly imagined excursion into the future. A military coup has taken place in the United States–the year is 2012–and General Thomas E. T. Brutus, Commander-in-Chief of the Unified Armed Forces of the United States, now occupies the White House as permanent Military Plenipotentiary. His position has been ratified by a national referendum, though scattered disorders still prevail and arrests for acts of sedition are underway. A senior retired officer of the Unified Armed Forces, known here simply as Prisoner 222305759, is one of those arrested, having been convicted by court-martial for opposing the coup. Prior to his execution, he is able to smuggle out of prison a letter to an old War College classmate discussing the “Origins of the American Military Coup of 2012.” In it, he argues that the coup was the outgrowth of trends visible as far back as 1992. These trends were the massive diversion of military forces to civilian uses, the monolithic unification of the armed forces, and the insularity of the military community. His letter survives and is here presented verbatim.

It goes without saying (I hope) that the coup scenario above is purely a literary device intended to dramatize my concern over certain contemporary developments affecting the armed forces, and is emphatically not a prediction. — The Author

Democracy is not sexy....Pournelle pointed out that the Left doesn’t like the "messiness" of democracy. Very seldom does one get to start with a Blank Sheet of Paper, in Year Zero and rebuild society as it OUGHT to be. Instead one has wheel and deal and make compromises. It’s not as sexy as "The Revolution."
