A recent refusal by the Supreme Court to review the case of Matthew Cooper of Time and Judith Miller of the NY Times, has left them both headed for jail for refusing to reveal their anonymous source in the Plame affair.

Time, it seems, has decided to reveal the source, one guesses over the objection of the reporter:
Time Magazine said on Thursday it would comply with a court order to hand over subpoenaed records to a grand jury in a move that could spare one of its reporters jail for refusing to reveal confidential sources.

A judge on Wednesday gave Matthew Cooper of Time and Judith Miller of the New York Times one more week before deciding their sentence for refusing to reveal confidential sources to a grand jury investigating the leak of a covert CIA operative's name to the news media.
I don't think any of us would be too thrilled for being jailed for standing up for our principles, and it seem both Miller and Cooper were willing to do so.

Now Time has decided to unilaterally void the principle and comply? Was Cooper a part of this decision? Was Cooper consulted?

I'll be interested to hear what Miller and Cooper have to say about this, but particularly Cooper, who's company has now left Miller alone hanging out there to dry.

UPDATE: Per the WSJ Cooper has had this to say:
"Now they've got a decision to make, and I've got one," he said. "A corporation is not the same thing as individual. They have different responsibilities and obligations and there is no dishonor obeying a lawful order backed with the force of the Supreme Court of the United States. I prefer they not hand over documents that disclose the identity of my sources, but that's their decision to make."
OK, this doesn't sound like a guy who's all that keen on paying the price for principles. I'm sorry, I'm not trying to be intentionally objectionable, but "there is no dishonor obeying a lawful order backed with the force of the Supreme Court of the United States" says, "hey, I've taken it as far as I really want to take it, and in reality I'd love it if you'd bail me out of the spot I find myself in, please", to me. I mean he could have made the same statement and turned the source over himself earlier this week, couldn't he?

What I hear in "that's their decison to make" is a silent "thank you Jesus" on the end.

Don't get me wrong, its easy to sit here, not facing 18 months jail time, and say he's bailing, but hell, you look at his words and tell me what they say to you.

I would guess that Cooper didn’t want to go to jail, and Time was willing to take the heat, since it’s a faceless corporation and could save him some face. I rather doubt that they would comply in turning over Cooper’s notes if Cooper himself objected.

Why shouldn’t they have to comply? What makes journalists have the right to withold information that any other American citizen would have to submit?

Why doesn’t Bush simply order the official who was the source to disclose his identity.

Why are you upset with Time and not the administration? Oh wait - that’s a silly question, isn’t it?

Well yeah.

A)Bush has nothing to do with it and B) I’m not "upset" with Time.

I’m noting that Time is willing to give up the source because of ’legal concerns’, and that bothers me. I’m also not sure it was all TIME corporate’s idea after reading the Cooper quote.

Well, it was one of his employees. He has control over his employees. He can order them to do things. If it was not a crime, which seems to be the party line, then there is nothing to worry about. Simple as that. Seems like the ethical thing to do.

Without the name of the source who is Bush supposed to order? Or do you know who it is? Give him up for all our sakes! I am tired of this story.

By the way, it isn’t the party line. Most have no idea, including me. Of course most of us have no idea because we really don’t care. A few have suggested there was no crime. The most prominent being the editorial page of the New York Times, well known for toeing the Bush machine line.

I think he means Bush says, "Now who did this?", and a civil servant comes forward and says, "me sir, sorry, I’ll never do it again" or some such thing.

In Coopers shoes I would be grateful too, if someone went over my head with a decision like that - it’s kinda an easy way out, but without really comprising your own morals. It will be interesting to see how Miller reacts.
