Alito: Fumbling the "Corn Gambit"

David Corn was pleased we named the Democratic strategy for defeating the Alito nomination after him (the "Corn gambit"). Credit where credit is due, he did indeed articulate it last year.

Corn, having recently returned from Europe then notes:
That's indeed what I suggested. I still believe there is nothing wrong with slugging it out over Supreme Court nominees on grounds of policy and legal substance. Many rightwingers want judges who will produce the outcomes that the think will best serve the nation and its citizenry. What's wrong with saying a justice who is likely to restrict (or end) access to abortions is no justice for me?
Well, speaking strictly of the political aspects of this, it depends on how well it's executed doesn't it? Which brings us to the key question:
But have the Democrats been able to make that case in compelling terms? I didn't get to view the hearings today—being stuck in an airplane for over eight hours. So you tell me.
One word: No. Oh the heck with it, two words: Hell no!

The public view of the Democratic opposition will be Kennedy carping on and on about Vanguard, hoping some of this non-issue would stick. The overall take on it will be that it was the usual Senatorial load of hot air.

It’s better than previous hearings though, isn’t it, because there was no tedious asking of questions that the candidate could comfortably and even righteously refuse to answer.
