The Supreme Court yesterday rejected a petition from BlackBerry maker Research in Motion Ltd. for a rehearing of its patent-infringement case, setting the stage for a possible court-ordered shutdown of most of its 4 million e-mail devices in the United States.

I read from somewhere this morning (can’t find it again) that Government and emergency workers will be exempt until RIM finds something else, so that will elleviate the problem hopefully for a little while.

I can tell you exactly how it would work if the courts did this: Congress would quickly and brutally eviscerate the entire USPTO and completely rework the idea of Intellectual Property. The pressure on them to do so would be enormous, and I don’t see Congress as being some sort of pillar of strength against the teeming masses right now.

I’m pretty sure the USPTO sees it the same way, since they are by all appearances moving full speed ahead to invalidate the patents that would lead to this injunction.
