Haditha Marine cleared of all charges

LCpl Justin Sharratt has been cleared of all charges against him in the alleged murder of three Iraqis in Haditha, Iraq in 2005.
"The evidence does not support a referral to a court-martial," Lt. Gen. James Mattis wrote in his written decision.
LTC Paul Ware, who conducted the Article 32 investigation was absolutely unequivocal in his findings. If you read it, as I did, he said it wasn't a matter of argument, but that the forensic evidence completely backed the testimony LCpl Sharratt gave while it didn't at all back the government version of the event. He was none to kind to the NCIS either.
In his recommendation, Lt. Col. Paul Ware said murder charges brought against Sharratt were based on unreliable witness accounts, poor forensic evidence and questionable legal theories.

"The government version is unsupported by independent evidence," Ware wrote in an 18-page report. "To believe the government version of facts is to disregard clear and convincing evidence to the contrary."
Fairly straight-forward wouldn't you say? You might recall that I participated in an interview with Darryl Sharratt, Justin's father, recently in which he related 53 attempts to contact Rep. Murtha who, unfortunately, happens to be his Congressional Representative. When he finally did get him on the line, he talked about everything but the case. His office had previously told Darryl that since the case was still pending they'd have no comment.

Well it's no longer pending ... it is settled.

Congressman Murtha ... call your office.

I’m trying to understand why people are treating the exoneration of these two Marines as a thorough debunking of Murtha’s accusations. Isn’t there still a formidable case against several other Marines involved in the Haditha incident?

If those Marines are implicated in the same killings, how will the forensic evidence exonerate one and not the others? The evidence either supports the charges of murder or it doesn’t. According to Ware’s findings in the Article 32, it doesn’t.

If I’m not mistaken, many of the charges still pending have nothing to do with the particular incident per se, but more to do with failures of command and leadership in the investigation and reporting of the incident.

My understanding is that one Marine received immunity for his testimony that implicated Wuterich for killing five Iraqis trying to surrender. And that those supposed murders were being investigated separately. I would very much like to see all of these young men come out clean. However, I’m still not following the logic. Admittedly, I don’t have the grasp that you do on these matters. But, it seems to me that if the evidence that Ware pointed to when making his recommendations regarding Sharratt and Stone were applicable to all of the murders then he should have been able to make a similar recommendation for the others that are accused as well. Maybe I’m just reading bad information or I missed a link in the story.

Yup, you’re right, I mistakenly thought you were talking about the 3 who were killed by Sharratt and another Wuterich. Wuterich has a total of 18 charges of murder against him.

Dela Cruz got immunity but wasn’t a witness to the Sharratt incident. Wuterich, however, was with Sharratt, so my guess is the three charges of murder stemming from that incident will end up being dropped against Wuterich as well.

Why don’t you ask Mr. Nifong, what jumping the gun has done to him. Next time, think my friend before you leap....because the pool maybe empty.
