Our man Murtha

This guy is a poster boy for what is wrong with Congress.

You want transparency in government? "Tough S**t" per John Murtha (Congressional Quarterly Weekly-subscription):
“Still, the new House disclosure rules could threaten Murtha’s old-school way of doing business. Forced to disclose earmark sponsors and amounts this year for the first time, the subcommittee chairmen were put in a position of explaining a great deal about how the process benefits some lawmakers more that others – even if many details of the process remain in the dark. Murtha was in no mood to make transparency easy.”

“In reporting earmarks, all Appropriations subcommittees separated their list of project sponsors from information about dollar amounts. Though the information was published, the method made it impossible to quickly assess who got how much in each bill. Murtha took the extra step of marbling the projects and their dollar values throughout the committee report on the bill, rather than compiling an easy-to-read list.” …

“Lawmakers say the winners in the process thrive on their ability to keep the rest of the rank and file in the dark about the distribution of money for special projects. Murtha is no exception.”

“After a recent House vote, he stopped for a moment in the lobby adjacent to the House floor, just steps from his corner, to take a question from a reporter about the difficulty of piecing together which members got how much money for which projects in his bill.”

“Murtha answered abruptly before walking away. ‘So, you have to work,’ he said. ‘Tough [expletive].’”
Such a "servant of the people" is our Representative ABSCAM.

But he's finally been called on the carpet for his outrageous remarks about the Marines in Haditha which accused them of being cold-blooded murderers before an investigation had ever been conducted. One of the Marine Sergeants he slandered, and who has since been exonerated, wasn't too impressed with Murtha and has sued him. Murtha claims he was acting in his official role as a lawmaker. The judge wants an explanation anyway:
U.S. District Judge Rosemary M. Collyer said the congressman might be right, but said she won't know for sure unless Murtha explains himself. She did not set a date for Murtha's testimony but said she would also require him to turn over documents related to his comments.

Collyer said she was troubled by the idea the lawmakers are immune from lawsuits regardless of what they say to advance their political careers.
I don't imagine he will ask her "is the case still active" to avoid making a comment, but given his brazen and arrogant behavior of the past, it certainly wouldn't surprise me if he tried.

I’ve seen the argument that he is, in fact, immune.

The idea itself is offensive.

I do understand why there are laws protecting representatives from *arrest* during sessions of congress. Politics have always had a rough and tumble element to them and arresting someone in order to influence a vote (ie., they aren’t there to cast it) makes one think of the Governor of Texas putting up road blocks and sending the police to apprehend representatives avoiding a recorded vote by fleeing to New Mexico! It’s sort of the opposite of using the police to keep them from voting, but...

In any case, the idea that a Congressman is excused from the consequences of slander or libel is obscene.

The (not) funny part is reading the defenses of Murtha that are essentially based on the "fact" that the Haditha Marines are guilty, no question. And the fact that the reason everyone is so convinced that they are unquestionably guilty is in a very large part due to the statements made by ex-Marine Murtha.

If he asks that question, she should most certainly respond with "It is... And thus you never should have spoken in the first place."

And since, as Synova points out, his defense is predicated upon the "fact" that the Marines were guilty, he’s boned.

Since the Marine suing him is not guilty, as judged by the military findings.

I gotta tell ya.....he’s really rapidly rising up there on the "repellent" meter. He’s not in Teddy Kennedy country, but he’s getting awful close.

Still, he (and old line scum like him in both parties) keeps getting elected so it’s not like we don’t deserve it, or what he represents

The trouble with moonbats, Bithead, is that trying to make fun of them through exaggeration is all but impossible. Not knowing Don, above, I have no way to tell if he’s an ordinary moonbat, obdurately trying to twist reality, or if he’s making fun of them and failing because it’s impossible to outcrazy a moonbat.

Synova, Members of Congress are immune for sure when speaking in debate on the floor of the chamber. Gradually, they’ve tried to build in immunity for themselves in every venue they can. Thus, the new claim is that Murtha, e.g., is immune to claims based on his speech so long as he is acting in his role as Congressman. And, of course he claims that he’s always acting in his role as Congressman, so he can say anything he wants without fear of being sued for slander or lying or whatever.

This is how tyranny begins, with dual standards and exemptions from the law for those making the laws.

Jessie MacBeth was talking truth to power, too. He may have been a fake soldier, but his story was accurate.

The same can be said of Rather/Mapes, as we all know.
