Democratic National Committee chairman Howard Dean announced Sunday that his organization will file a complaint on Monday with the Federal Election Commission, asking them to investigate whether Arizona Republican Sen. John McCain is breaking the law by reversing his decision to use public funding for his presidential campaign.

"John McCain cannot unilaterally withdraw from his spending limit," said Dean on a conference call with reporters. "He cannot be let out of the matching funds program if he's already used the promise of matching funds for loans or collateral for private loans."

What was the name of that bill - oh, yeah, McCain-Feingold, right?

Even more funny because this goes right to "Congressional intent".

I’d think that just maybe they guy who wrote the bill would know all the loopholes.

You just have to wonder just what Dean doesn’t want the FEC investigating that he has them wasting taxpayers money off on this "wild goose chase."

Why did Dean use the adverb, "unilaterally," in his statement? It seem certainly unnecessary and probably nonsensical.

Oh well, if Dean succeeds in having McCain be hoisted by his own petard, then I suppose that I might forgive Dean his banal rhetoric.

It gets better. The FEC could vote to allow McCain to withdraw, if they had a quorum. They don’t have a quorum because McCain’s "Gang of 14" shenanigans neutered the Republicans’ attempts to fix the confirmation mess, in the process throwing all but a few high-profile judicial appointments under the bus, including the four missing members of the FEC that Bush has nominated but who have not been approved.
