"Child" Porn is Bad
Posted by: Dale Franks on Sunday, December 21, 2008

I don't know whether I wrote about this in 2003, when the law was first passed. I Googled for it and I didn't find anything. So I guess I missed it when the law was passed. That's the thing about blogging. You don't have time to notice or write about everything. But this little tidbit popped up on the news widget I run on my desktop.
Child pornography is illegal even if the pictures are drawn, a federal appeals panel said in affirming the nation's first conviction under a 2003 federal law against such cartoons.

Dwight Whorley of Richmond is serving 20 years in prison, convicted in 2005 of using a public computer for job-seekers at the Virginia Employment Commission to receive 20 Japanese cartoons, called anime, illustrating young girls being forced to have sex with men. Whorley also received digital photographs of actual children engaging in sexual conduct and sent and received e-mails graphically describing parents sexually molesting their children.
So, apparently in 2003, Congress decided that if you draw or receive drawings of underage children having sex, you are a pedo, and have to go to jail. For naughty drawings. And now, the 4th circuit has ruled that convictions for receiving naughty drawings are perfectly OK.

No children were harmed in making the drawings. No minors were forced to have sex. But the possession of these drawings is so bad, you just have to be tossed into prison for a few years.

What complete ninnies we've turned into.

How can you tell how old a cartoon character is anyways?

You know, by the time he gets out of jail, those drawings will be old enough to vote.

So now we have to arrest Japan.

So apparently bondage pics are rape? At least in those cases, it involves real people and not imaginary cartoon characters (I know it’s very difficult for our elected and appointed governmental officials to tell the difference). This could get tricky, since we now could interpret a stick figure that is proportionally smaller than another to be a child and god forbid any indecent actions be illustrated between those figures. Stick figures could give us great trouble; is the following figure lying in a pool of blood murder? I’d have to believe our courts would say yes:

...O-|—<...

The good news is that we just found a cartoon of 31 million ballots all Norm Coleman, which blows Franken out of the park (of course, Franken has always been a cartoon character so we should be careful to watch if he doesn’t bring this election to a "draw" again).

Remember, government jobs are *hard* and confusing, irrational decisions appearing to be insane are the case only because we can’t appreciate how immensely difficult redistributionist social relativism really is.

I thought that the SCOTUS ruled on March 26, 2007 in U.S. v. Williams that Internet computer images of what one could call child porm were not illegal. So what is the difference? While I disagree with that ruling, we are a nation of laws, so . . . .

Cartoon = not people, not porn.
Dirty manuscript = not people, not porn.
Video of children having sex = child pornography, coerced or not.
One-time receiving of said video = should not be criminal.
A pattern of receiving and sending said videos = facilitating/distributing child pornography, clearly criminal.

Sorry, should be "Video or photos of children..." and "...sending said videos or photos..."

Ok, so what are they going to do about Rule 34?

I forgot to warn that the link is NSFW and it has a *really* annoying popup in the bottom corner.

I am highly hesitant to click a NSFW link on a thread like this. Please describe the link further...

Rule 34: If it exists, there is porn of it.
So how does that relate to classifying child porn?

Photos of adults having sex: porn
Photos of children having sex: Child porn.

Photo of a banana having sex with coffee grounds [wtf, rule 34?] : Not porn

I could not disagree more.

Child porn needs to be stamped out all over, whether it is real or cartoons (cartoons that show children having sex? Come on!).

Only sickos deal in stuff like this. If we can nab them and send them to hoosgow before they hurt real children, I say throw their sick behinds in prison and leave them there. Let them rape each other and feel the effects child porn has on society.

I for one have no fear if government does this. I applaud it. I am glad to hear someone is doing something about it, too.

"If we can nab them and send them to hoosgow before they hurt real children..."

Interesting. Do you call that thought crimes or preventive detention or something like administrative holding?

Gotta throw in with timactual re: James Marsden.

Look, I want child molesters and kiddie rapists punished in ways that would make Spanish Iquisitors nauseous, but people should only be punished for having committed an actual crime (or clearly planned to do so). I like anime and mangas and have seen a few that were... ahem... discomfiting. However, I don’t consider myself a criminal for looking at them, nor would I consider anybody else to be a prospective child molester who must be jailed for doing the same.

If I observe a flaw in a bank’s security, and fantasize about robbing the bank, should I be "nabbed and thrown in the hoosgow before I hurt real banks"? The simple fact is, most people are capable of self-restraint. That line between punishing disagreeable actions and punishing disagreeable thoughts is very important.

The truth here, I think, is that child porn (drawn or otherwise) just pegs our "icky" meter. It’s very creepy, and we wish it could go away. That’s not a legitimate reason for censorship! There are plenty of shock images I’ve been unfortunate enough to see on the internet that I strongly wish to never see again, but making such images illegal to own? Making them illegal to show to someone who seeks them? Prior restraint? I think not.

We have a special set of laws against child porn, justified by the SCOTUS specifically because the social harm of the creation of the images is so high. That line of argument makes good sense, but clearly doesn’t apply here. What basis is left, then, for outlawing drawn child porn? That it’s repulsive? Bad idea. That we should arrest people because their fantasies are repulsive? Really bad idea.

So many comments about it being bad however if you type the words porn , naked , pics etc into the search engine of your choice what do you get. Pornography is your number one hit. Interesting? How about playing the game and making porn sites come up on page 20 instead. Interested. Well take your own website, if you have one, stick a page in there about why porn is bad, what it does to people, get you Rev,Min,Priest to write something if your not feeling inspired. Make sure you talk about all the dirty stuff using the same words they use. This way all the search engines will pick up on those websites and actively promote them on their lookups. Now you have the tool. Promote this page by looking up the page on the internet search engine of your choice. Even if your page is last in the list go to the end and click on it. Tell all your friends, family members, church congregation whoever to do the same everyday just once for a year. Guess what’s going to happen your site is going to get more hits than porn sites and soon your site will come up closer to the beginning than the filth. You need to promote the answer for kids to be informed before it becomes a problem in their lives. Take an existing web site that promotes the answer and spread the link to their web site so that people can look these web sites up. Take a positive step in curbing the great internet pornography advertisement that exists. Not to mention parental control etc..
